CONGRESS NEEDS TO HEAR INDIAN COUNTRY! The CLARITY Act could hit the Senate floor this week and the Indian Gaming Association urges our Member Tribes to act quickly to contact your Senators to VOTE NO on the CLARITY Act unless it protects Tribal economies, IGRA, and Tribal and State Gambling Laws.  

IGA, along with our partner organizations, have consistently met with members of the United States Senate for the past several months, urging Senators to include a provision in the Digital Asset Market Clarity Act (“CLARITY Act”) to codify existing CFTC regulations that prohibit registered entities from listing trades relating to, involving, or referencing sports and casino-style gambling and affirm that the Indian Gaming Regulatory Act (“IGRA”) and tribal and state gambling laws have full force and effect. The tribal savings clause is posted below for your reference.

The CLARITY Act is the most viable legislative vehicle to address our longstanding concerns with online sports gambling through prediction markets. The CLARITY Act seeks to legitimize the cryptocurrency industry by setting regulatory guidelines for the Securities and Exchange Commission (“SEC”) and the Commodity Futures Trading Commission (“CFTC”). As currently drafted, the CLARITY Act would permit prediction markets to expand their sports betting activities into casino-style gambling and the cryptocurrency financial system. 

Thanks to our work, the savings clause was included in the Democratic counterproposal during the ongoing negotiations about the CLARITY Act. However, we just learned that the Senate Agriculture leadership has rejected Indian Country’s savings clause and Senate Leadership may force a vote on the CLARITY Act this week. 

We ask that you exercise your voice by calling on your Senate delegation and Senators that you know to “VOTE NO on the CLARITY Act, unless the bill includes Indian Country’s provision to confirm that prediction markets cannot offering contracts on sports and casino gambling and ensure that IGRA and tribal and state gambling laws have full force and effect. 

Again, our effort is gaining real momentum, and we need your help to protect Tribal economies, IGRA, and Tribal and State gaming laws. Contact your Senators to send the message that prediction markets are an existential threat to Tribal sovereignty and our economies – and that Congress must act now to stop illegal online gambling through prediction markets.
